SM娛樂起訴KRIS非法利用EXO人氣 北京法院立案

SM娛樂表示，已起訴旗下男團EXO前成員KRIS、聘用KRIS的廣告商以及KRIS出演電影的製作公司，北京法院已於7月30日正式立案。

SM表示：「KRIS利用開展EXO活動而獲得的人氣，非法出演多部電影、廣告、活動和頒獎典禮。該行為道德不良、濫用法律，背棄了與本公司和其他成員之間的信任和情義。”

KRIS去年5月起訴SM娛樂，請求將二者簽訂的專屬合約無效化。之後，另兩名中國籍成員LUHAN和TAO也以同樣方式退出了EXO。今年2月，SM娛樂已向中國法院起LUHAN以及聘用LUHAN的廣告商。

以下是SM娛樂聲明全文：

SM娛樂作為EXO前成員KRIS和LUHAN唯一合法的經紀公司，已於2015年2月向LUHAN在中國開展的非法演藝活動，以及聘請LUHAN作為產品代言人的廣告商提起訴訟，並已經向中國法院正式提交訴狀。對於KRIS在中國的非法演藝活動，我們已起訴KRIS以及聘請KRIS代言的廣告商、KRIS出演電影的製作公司等，北京法院已於7月30日正式立案。

KRIS已於2014年5月在韓國單方起訴我公司，並擅自退出組合。他利用開展EXO活動而獲得的人氣，非法出演了多部電影、廣告、活動、頒獎典禮等，這些活動均侵害了SM娛樂和EXO成員們的合法權益，也導致SM娛樂和多家國內外合作公司的合約關係出現嚴重問題，並引起重大經濟損失。該行為道德不良、濫用法律，背棄了與本公司和其他成員之間的信任和情義。

在法院下達最終判決之前，SM娛樂與KRIS簽訂的專屬合約依然有效。在專屬合約期間內擅自開展的所有商務工作和廣告代言、電影拍攝等演藝活動均是違反合約的非法行為。對此，KRIS應承擔所有法律責任。與此同時，隨聲附和KRIS違約行為的公司及個人也侵害了SM娛樂與EXO的權利和利益，本公司將動用一切法律手段，追究他們的的法律責任。
